What should I do if the insurance company contacts me after an accident?

Once your accident is reported, representatives from either your or the at-fault party’s insurance company may contact you. It is important to avoid speaking with them before speaking to an attorney. For example, the at-fault party’s insurance may pressure you into signing a settlement worth far less than what an experienced accident attorney would recommend signing. 

Will I need to pay my attorney any money out of pocket?

No! At Katz Law, we handle all of our injury cases on contingency basis.  A fee is contingent when it is conditioned upon successful resolution of your case. This policy is also known as "No fee unless you win." A Contingent Fee is paid as a percentage of your monetary recovery (either settlement or court award).

What kind of compensation am I entitled to as a result of my injuries?

Generally, you are entitled to payment of all medical bills, lost wages, and pain and suffering. Pain and suffering damages cannot be easily quantified, but are intended to compensate you for physical and emotional pain suffered as a result of an accident.

What can an attorney do if the cause of the accident is in dispute?

Accidents happen for many reasons. The job of an attorney is to try and locate evidence or legal theories that would support your claim. As part of our claim retention procedure, we will listen to your account of what happened, then (if needed) carefully investigate the accident scene, and review documentation such as police reports.

Should I go see a doctor after an accident?

Absolutely. While we highly recommend you to visit a medical professional if you are suffering any form of pain, we also recommend you do so even if you feel fine. We’ve handled many cases involving accident victims who thought they were fine, only to realize that they had an internal injury that took time to become readily apparent. Aside from your personal well-being, seeing a medical professional right away also helps to protect your legal rights. If you wait too long, an insurance company may argue that your injuries are not real since they were not treated immediately after the accident.

Why do I need an attorney to file an injury claim?

While victims of car accidents are not required to hire an attorney to make a claim to an insurance company, we do not recommend it. The process of getting compensation for an auto accident is quite complicated, especially if multiple insurance companies are involved, and missing a deadline or misfiling paperwork could be fatal to your case. Moreover, the insurance companies themselves have counsel, and their lawyers and adjusters are paid well to reduce or deny claims. Having an attorney on your side will help you counter their arguments and protect your rights.

I am injured but I don't like lawsuits. Can I still pursue a claim? 

Most injury claims relating to accident do not end up in lawsuits. After you are fully recovered from your injuries, our office will file a claim with the insurance company. In most cases your attorney (with your approval) and the adjuster negotiate a fair monetary settlement for your injuries. If the insurance company is willing to offer adequate compensation, then your case will be resolved without Court and without a lawsuit.

What are the most common causes of auto accidents?

There are two main categories of common causes of accidents: 1) distracted driving (drivers who are texting, talking on their cellphones, changing radio stations, having conversations with passengers, etc.); or 2) poor road conditions (failure of the local or state government to maintain adequate road conditions).
